Terms of Service

1. Agreement to Terms

By accessing or using bountyhunters.land (the "Platform"), operated by [OPERATOR_NAME] ("Bounty Hunters," "BH," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy (collectively, the "Agreement"). If you do not agree to the Agreement, do not access or use the Platform.

You acknowledge and agree that this Agreement is solely between you and Bounty Hunters. It does not govern any sale, transaction, or other relationship between you and any other User or third party.

2. Our Role

The Platform provides a matchmaking service that connects vehicle buyers ("Hunters") with vehicle sellers ("Outlaws"). Hunters post specifications for vehicles they are seeking, and Outlaws may respond when they have a matching vehicle.

BOUNTY HUNTERS IS NOT AN AUTOMOBILE BROKER, DEALER, TRADITIONAL AUCTIONEER, CONSIGNMENT SERVICE, OR ESCROW AGENT. WE DO NOT SELL, EXCHANGE, BUY, OR OFFER FOR SALE, NEGOTIATE OR ATTEMPT TO NEGOTIATE, A SALE OR EXCHANGE OF AN INTEREST IN ANY VEHICLE LISTED ON OR CONNECTED THROUGH THE PLATFORM. BOUNTY HUNTERS HAS NEVER: (1) HELD TITLE FOR ANY VEHICLE LISTED ON THE PLATFORM, (2) INSPECTED ANY VEHICLE LISTED ON THE PLATFORM, OR (3) HAD ANY VEHICLE LISTED ON THE PLATFORM IN ITS POSSESSION.

We provide an introduction and matchmaking service only. Any vehicle transaction that results from a connection made on the Platform is conducted entirely and exclusively between the buyer and seller.

3. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use the Platform. By creating an account, you represent and warrant that you have the legal capacity to enter into this Agreement, that you meet these eligibility requirements, and that all information you provide is accurate, current, and complete.

4. Account Registration

You may create only one account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not responsible for any loss or damage resulting from unauthorized use of your credentials. We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

5. Bounty Posting

Hunters may post a "Bounty" specifying the year, make, model, and up to three must-have specification preferences ("Must-Haves") for a vehicle they are seeking. Bounties are publicly visible on the Bounty Board for a period of six (6) months from the date of posting. You may edit your Must-Haves at any time, but the make, model, and year range cannot be changed after posting.

6. Fees and Payment

Posting Fee. Posting a Bounty is free. Each submitted Bounty is reviewed by a Bounty Hunters administrator before being published to the Bounty Board. Approved Bounties remain active for six (6) months. Bounty Hunters reserves the right to reject any submission at its sole discretion.

Introduction Fee. A non-refundable fee equal to one percent (1%) of the estimated vehicle value (minimum $250.00 USD) is charged to the Hunter (buyer) after a Bounty Hunters administrator has verified the seller and their vehicle as legitimate. This fee unlocks the introduction to the verified seller and initiates the Showdown. The introduction fee compensates Bounty Hunters for the vetting, verification, and introduction service. It is earned upon administrator approval and is non-refundable regardless of whether the Showdown results in a sale, the underlying vehicle transaction ultimately closes, or is satisfactory to either party. The estimated vehicle value is determined by Bounty Hunters based on available information including but not limited to the seller's asking price and the buyer's stated budget range.

Scope of Verification. Administrator verification is limited to confirming the seller's identity, vehicle ownership, and that the vehicle generally matches the bounty's year, make, and model. Verification does NOT constitute an inspection, appraisal, endorsement, or guarantee of the vehicle's condition, mechanical soundness, accident history, title status, or fitness for any purpose. Buyers are solely responsible for conducting their own independent inspection and due diligence before entering into any transaction. The fact that a seller has been "verified" or "approved" by Bounty Hunters shall not be construed as a representation or warranty regarding the vehicle or the seller's claims about it.

No Refunds. All fees paid to Bounty Hunters are non-refundable. The introduction fee covers the cost of verifying the seller, their vehicle, and facilitating the introduction. It is not contingent on a completed sale. Any vehicle transaction resulting from a connection made on the Platform is between the applicable buyer and seller; in the event you seek a refund related to a vehicle purchase or have any dispute regarding a transaction, you must deal directly with the other party.

Payment Processing. All fees are processed through Stripe, Inc. Bounty Hunters does not store, access, or have visibility into your payment card details. By submitting payment, you also agree to Stripe's terms of service.

Fee Changes. We reserve the right to modify our fee schedule at any time. Changes will be communicated via email at least thirty (30) days before taking effect. Fee changes do not apply retroactively to Bounties already posted or introduction fees already incurred.

7. Vehicle Information and User Content

"User Content" means any and all information and content that a User submits to the Platform, including vehicle descriptions, specifications, photographs, condition reports, profile information, and any other materials. You are solely responsible for your User Content. You assume all risks associated with use of your User Content, including any reliance on its accuracy by others.

ALL VEHICLE DESCRIPTIONS, SPECIFICATIONS, PHOTOGRAPHS, CONDITION REPORTS, MILEAGE FIGURES, HISTORY, TITLE STATUS, AND ANY OTHER VEHICLE INFORMATION DISPLAYED ON THE PLATFORM ARE PROVIDED SOLELY BY THE SELLING USER (OUTLAW). BOUNTY HUNTERS DOES NOT INSPECT, VERIFY, APPRAISE, AUTHENTICATE, CERTIFY, OR GUARANTEE THE ACCURACY, COMPLETENESS, OR TRUTHFULNESS OF ANY VEHICLE LISTING OR ANY INFORMATION PROVIDED BY ANY USER.

We make no representations or warranties, express or implied, regarding any vehicle listed or referenced on the Platform, including but not limited to its condition, merchantability, fitness for a particular purpose, title status, accident history, or compliance with applicable laws. You acknowledge and agree that you rely on vehicle information provided by other users entirely at your own risk.

By submitting User Content, you grant Bounty Hunters a non-exclusive, worldwide, royalty-free, irrevocable license to use, display, reproduce, distribute, and create derivative works of that content in connection with operating and promoting the Platform. You represent and warrant that you have the right to grant this license and that your User Content does not infringe the rights of any third party.

8. Transactions Between Users

ALL VEHICLE PURCHASES, SALES, AND RELATED TRANSACTIONS ARE CONDUCTED DIRECTLY BETWEEN THE BUYER AND SELLER. BOUNTY HUNTERS IS NOT A PARTY TO ANY VEHICLE TRANSACTION. ALL VEHICLES CONNECTED THROUGH THE PLATFORM ARE SOLD STRICTLY ON AN "AS-IS, WHERE-IS" BASIS.

Bounty Hunters does not facilitate, arrange, manage, guarantee, or participate in any aspect of a vehicle transaction, including but not limited to:

• Payment or purchase price negotiation
• Financing or lending
• Escrow services
• Vehicle inspections or appraisals
• Title transfer or registration
• Transport, shipping, or delivery
• Insurance or warranties of any kind

It is the responsibility of the buyer and seller to negotiate the terms of a binding transaction and enter into a formal agreement. This contracting is outside the scope of the Platform. The buyer and seller are solely responsible for conducting due diligence, verifying vehicle information, arranging payment, and transferring title and possession.

9. User Responsibilities

Hunters (Buyers). You agree to post Bounties in good faith with genuine purchase intent. Posting a Bounty does not obligate you to purchase any vehicle, but it represents that you have a sincere interest in acquiring the specified vehicle. You acknowledge and agree that Bounty Hunters bears no risk associated with purchasing a vehicle from a seller connected through the Platform.

Outlaws (Sellers). You are responsible in all respects for the accuracy of your User Content and any information related to any vehicle you list. You agree to provide accurate and truthful vehicle information and must disclose all known material defects, damage, title issues, and any other information that a reasonable buyer would consider relevant. Misrepresentation of a vehicle may result in immediate account termination.

All Users. You are solely responsible for conducting your own due diligence before entering into any vehicle transaction. This includes but is not limited to: independent vehicle inspections, title and lien searches, VIN verification, mechanical assessments, and verification of seller identity and ownership. Your interactions with other Users are solely between you and such User.

10. Prohibited Conduct

You agree not to:

• Post spam, fraudulent, or duplicate Bounties
• Provide fake, misleading, or materially inaccurate vehicle information
• Harass, threaten, or abuse other users
• Attempt to circumvent Platform fees or facilitate off-platform transactions to avoid fees
• Scrape, harvest, or collect data from the Platform by automated means
• Use the Platform for any unauthorized commercial purpose
• Impersonate another person or entity
• Interfere with or disrupt the Platform's operation or infrastructure
• Transmit viruses, malware, or other harmful code
• Collect personal information of other Users without their explicit consent
• Violate any applicable local, state, or federal law

We reserve the right to take any action we deem appropriate if we become aware of a violation, including suspending or terminating your account, removing User Content, and cooperating with law enforcement authorities.

11. Assumption of Risk

You acknowledge and agree that buying and selling vehicles involves inherent risks, including but not limited to mechanical defects, undisclosed damage, title problems, fraud, financial loss, and personal safety risks when meeting other parties. Bounty Hunters provides the introduction and matching service only. Everything that occurs after a match — including all communications, negotiations, inspections, payments, and the transaction itself — is entirely between the parties involved. You assume all risk associated with any vehicle transaction facilitated through an introduction made on the Platform.

12. Release

If you have a dispute with one or more Users of the Platform or any third party, you release Bounty Hunters (and its owner, officers, agents, affiliates, service providers, and payment processing partners) from all claims, demands, liabilities, costs, expenses, and damages (actual and consequential, of every kind and nature, known and unknown) arising out of or in any way connected with such disputes.

IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

13. Disclaimers

THE PLATFORM IS PROVIDED "AS-IS" AND "AS AVAILABLE" AND WE EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE PLATFORM: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (C) WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.

BOUNTY HUNTERS DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY VEHICLE OR OTHER PRODUCT OR SERVICE OFFERED BY ANY USER ON OR THROUGH THE PLATFORM. BOUNTY HUNTERS CANNOT ENSURE THAT A BUYER OR SELLER YOU ARE DEALING WITH WILL ACTUALLY COMPLETE A TRANSACTION OR IS AUTHORIZED TO DO SO.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

14. Limitation of Liability

IN NO EVENT SHALL BOUNTY HUNTERS (OR ITS OWNER, OFFICERS, AGENTS, AFFILIATES, OR SERVICE PROVIDERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO THIS AGREEMENT OR YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) TWO HUNDRED FIFTY US DOLLARS ($250.00) OR (B) THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO BOUNTY HUNTERS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE EXISTENCE OF MORE THAN ONE CLAIM SHALL NOT ENLARGE THIS LIMIT.

Without limiting the foregoing, Bounty Hunters shall have no liability whatsoever for:

• Vehicle defects, mechanical failures, or safety issues
• Misrepresentations, fraud, or omissions by any user
• Failed, incomplete, or unsatisfactory transactions between users
• Disputes between buyers and sellers
• Loss, damage, or theft during vehicle transport or delivery
• Title defects, liens, or encumbrances
• Any personal injury or property damage arising from a vehicle transaction
• Actions or inactions of other Users

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so in those jurisdictions our liability is limited to the extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Bounty Hunters (and its owner, officers, agents, affiliates, and service providers) from and against any and all claims, liabilities, damages (whether direct, indirect, incidental, consequential, or otherwise), losses, costs, and expenses (including reasonable attorneys' fees and accounting fees) arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) any vehicle transaction you enter into through connections made on the Platform; (d) your breach of this Agreement; (e) your violation of any applicable law or regulation; or (f) any actions or inactions of any third party to whom you grant access to your account.

Bounty Hunters reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

16. Intellectual Property

All content, design, branding, logos, trademarks, service marks, trade names, graphics, and software comprising the Platform are owned by Bounty Hunters and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, or make any other commercial use of any Platform content without our prior written consent.

17. Copyright Infringement

If you believe your copyright has been infringed by content on the Platform, you may provide us with written notice containing: (a) a description of the copyrighted work; (b) identification of the infringing material and its location on the Platform; (c) your contact information; (d) a statement that you have a good-faith belief the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. 18. Dispute Resolution

Disputes between Users. Any dispute arising from a vehicle transaction or interaction between Users is solely between those Users. Bounty Hunters may, at its sole discretion, attempt to assist in resolving disputes but is under no obligation to mediate, arbitrate, or otherwise intervene. Bounty Hunters shall have no liability for your interactions with other Users or for any User's action or inaction.

Disputes with Bounty Hunters. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement or the Platform shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.

19. Termination

Bounty Hunters may, in its sole discretion, suspend or terminate your account, remove User Content, or restrict your access to the Platform without prior notice and for any reason or no reason, including but not limited to violation of this Agreement. You may delete your account at any time through your Account Settings.

Upon termination or deletion, all fees previously paid are non-refundable. All rights granted by you to Bounty Hunters (including the license to your User Content) shall survive termination.

20. Modifications to Terms

We may modify these Terms at any time by posting an updated version on the Platform or by providing notice via email. For material changes, we will provide at least thirty (30) days' notice. Your continued use of the Platform after the effective date of any modification constitutes your irrevocable acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and delete your account.

21. No Waiver

No failure or delay by Bounty Hunters in exercising any right, power, or privilege under this Agreement will operate as a waiver thereof, nor will any single or partial exercise of any right preclude any other or further exercise thereof.

22. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

23. Entire Agreement

This Agreement (including the Privacy Policy) constitutes the entire agreement between you and Bounty Hunters regarding your use of the Platform and supersedes all prior agreements and understandings. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right or provision.

24. Notice to California Users

Under California Civil Code Section 1789.3, California users of the Platform are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 400 R Street, Suite 1080, Sacramento, California 95814, or by telephone at (916) 445-1254 or (800) 952-5210.
